On granting tariff preferences for goods declared in electronic form

In order to uniformly apply the customs legislation of the Customs Union, as well as in connection with the establishment of certain facts of violation of the conditions for granting tariff preferences by the customs authorities during the customs declaration of goods in electronic form, the Federal Customs Service of Russia informs the following.

In accordance with the Rules for determining the origin of goods from developing and least developed countries (annex to the Agreement between the Government of the Russian Federation, the Government of the Republic of Belarus and the Government of the Republic of Kazakhstan dated December 12, 2008 "On the rules for determining the origin of goods from developing and least developed countries") in for the purpose of granting tariff preferences, a person moving goods shall submit to the customs body a certificate of origin of goods on paper.

According to paragraphs 10, 11, 15 of the Rules for determining the country of origin of goods, approved by the Decision of the Council of Heads of Government of the CIS dated November 30, 2000, in order to confirm the country of origin of goods from the member states of the Agreement on the Establishment of a Free Trade Zone dated April 15, 1994, it is necessary to submit a certificate to the customs authorities of the country of import on the origin of goods of form ST-1, drawn up on a special, protected form of A4 format (210 x 297 mm), printed in a typographical way, the original of which is submitted along with the customs declaration.

Thus, a tariff preference for the customs declaration of goods in electronic form can be granted if all the necessary conditions for its provision, provided for by the customs legislation of the Customs Union, are met, including when submitting the original certificate of origin of goods to the customs authority.
